Mega IT Fair 2025 – Bid-Lah Campaign (Live Auction) Terms & Conditions
1. General
1.1. These Terms and Conditions govern the participation in the “Bid-Lah” campaign (“Campaign”) to be held as part of the Mega IT Fest 2025 at Plaza Low Yat, Main Concourse, organised by LYC Mall Sdn. Bhd. (“Organiser”).
1.2. By participating in the Campaign, all participants agree to be bound by these Terms and Conditions.
2. Live Auction
2.1. The Live Auction for the Campaign will take place on 30th August 2025 (Saturday) during the Mega IT Fest, as announced by the Organiser.
2.2. The Organiser reserves the right to change the said auction schedule at its sole discretion.
3. Eligibility
3.1. The Campaign is open to individuals aged 18 years and above.
3.2. Employees of LYC Mall Sdn. Bhd. and its tenants at Plaza Low Yatare not eligible to participate in the Campaign.
4. Auction Mechanics
4.1. All auction items will be clearly displayed and/or announced prior to bidding.
4.2. The starting bid and minimum bid increments for each item will be determined by the organiser and are not negotiable.
4.3. Bidders must register online prior to the event via the official registration platform provided by the Organiser. On the event day, all registered bidders are required to physically check in at the event venue and obtain a bidding number before participating. Last-minute participants (those who did not register online) may be allowed to join subject to availability and must complete on-site registration, agree to the auction terms, and obtain a bidding number before the auction for their intended item(s) begins. Admission for last-minute participants is at the sole discretion of the Organiser and may be limited due to capacity or administrative constraints.
4.4. All bids are final. Once a bid is placed and accepted by the auctioneer, it cannot be withdrawn.
4.5. The highest bidder, as determined by the auctioneer at the conclusion of each auction, shall be deemed the successful bidder and is obligated to purchase the item. The bidder is NOT allowed to withdraw their bid once declared the successful bidder. Failure to complete the transaction may result in among others, blacklisting from the auction and/or future LYC Mall Sdn. Bhd. events, and/or legal action, at the sole discretion of the Organiser.
5. Payment and Item Collection
5.1. Successful bidders must make full payment immediately after the bidding of the item concludes. Payment and collection must be completed before the next auction item begins (“Collection Period”), unless otherwise directed by the Organiser or auctioneer.
5.2. Accepted payment methods include QR code payments and bank transfers only.
5.3. Item concerned must be collected on-site upon full payment, unless otherwise arranged with the Organiser.
5.4. Failure to make payment and collect the item within the stipulated time will result in forfeiture of the item and the Organiser reserves the right to offer the item to the next highest bidder or re-auction the item.
5.5 All successful auction bids are final. Items are not exchangeable for cash, non-refundable, and cannot be returned or exchanged for other items.
5.6 The Organiser will not be responsible for storage or safekeeping of uncollected items beyond the Collection Period.
6. Limitation of Liability
6.1. The Organiser shall not be liable for any damage, loss, or injury arising from the participation in the Campaign or the use of any item won.
6.2. All items auctioned are provided “as is” basis and without warranty unless otherwisegranted.
7. Organiser’s Rights
7.1. The Organiser reserves the right to cancel, postpone, or modify the auction event or any part of the Campaign without prior notice.
7.2. The Organiser reserves the right to disqualify any participant found to be tampering with the bidding process or violating any rules concerned.
8. Personal Data Protection
8.1. Participants agree that their personal data collected during registration may be used for the purposes of conducting the Campaign and for marketing purposes, in accordance with the Personal Data Protection Act 2010 (Malaysia).
8.2. Participants may request access to or correction of their personal data by contacting the Organiser at its management office at 4th Floor, Plaza Low Yat.
9. Governing Law
9.1. These Terms and Conditions shall be governed by and construed in accordance with the laws of Malaysia.
9.2 By participating in the Campaign, participants agree to submit to the exclusive jurisdiction of the courts of Malaysia for the resolution of any disputes or claims arising out of or in connection with this Campaign.
9.3 If any provision of these Terms and Conditions is found to be invalid or unenforceable under Malaysian law, the remaining provisions shall remain in full force and effect.
10. Final Rights and Decisions
10.1. The Organiser reserves the right to make the final decision on all matters related to the Campaign, including but not limited to auction procedures, participant eligibility, bid validity, and disputes.
10.2. The Organiser also reserves the right to refuse, cancel, or revoke any transaction, purchase, or participation at its sole discretion, without prior notice or reason, especially in the event of suspected fraud, misconduct, or violation of these Terms and Conditions.
10.3. All decisions made by the Organiser and the auctioneer during the Campaign are final, conclusive, and binding. No appeals or further correspondence will be entertained.
